Thanks for hosting unbiased artciles/news/ discussions contrary to many knanaya related forums which shows overenthusiasm in tarnishing the image of the sabha. Many of us know nothing about Abhaya case & we are only guided by the highly biased media. How many of us has ever bothered to check the realties of the case?
Attached is the bail judgment pronounced by Justice Hema (CLICK HERE) who has studied the 24 volumes of the case diary? Please go through Pt No. 94 & 95 of Justice Hema's judgement which clearly shows where we are:-
94. But, media has pronounced the verdict already without looking into any of the above facts. The public has also joined hands, being carried away by the various publications effected through media, which do not contain the bare true facts which are revealed by the case records. A democlean sword of a threat of ill-repute is held over the head of any judge who may ever dare to lift his/her pen and write or speak any thing contrary to the "media-public verdict" which is already pronounced. The three persons are already sent to gallows. Then, why the system of criminal justice exists any more in this country? Many investigators, various officers of local police, Crime Branch, the "church", the "convent" and several others, dead and alive, are all in the dock. Even after the death of certain witnesses, allegations by media and public still haunt them.
95. Poor public. They do not know what the records bear. By the sustained brain washing on them, they may not be able to even accept any judicial pronouncement, which may run contrary to what they are made to believe so far. Honestly. The courts can go only on the basis of the facts covered by the case records. But, the public still chase the mirage. They fail to realise that the truth lies far away. I wish to state only these two lines: "Forgive them, Father. They do not know what they are doing!!"

If what is said above is true, then the organisations such as kana, the media and various people who are behind creating this public opinion which is contrary to court judgements and cbi enquiries inorder to continuously keep this tragic suicide case in front of the public inorder to tarnish Kottayam diocese are master manupulators and pure devils who will answer in the higher court of god one day.
ReplyDeleteBut, if the incident was a tragic murder then the people who are aware of the true facts and have worked to cover it up, have not spoken he truth and hide the truths have an even worse judgement waiting for them!

ReplyDeleteBut who will care about these facts. We want sensationalism from the Thresiammas and Jomons. We don't want facts from the Hemas & others.
Who cares of the fact that:-
1) CDAC has certfied that the Narco CDs are heavily tampered & edited to suit the questionnaire prepared by CBI
2) The accused voluntarily agreed for Narco analysis so that they can show their innocence
3) Thresiamma's rivalry with the accused much before Abhaya's death is very well known
4) CBI has selectively taken the statement of Thresiamma & ignored the statements of many other teachers of the same college
5) No body is interested to take upon the challenge of Sr Sephy that she will prove her virginity in front of any medical board
6) The suicide letters written by Abhaya
7) The arrest of the accused within one week of taking over the case by Kochi CBI team. Fix the accused & then search for evidence.
Remember the same media had reported that obscene albums of nuns were recovered from the room of an accused which turned out to be an absurd allegation but we wholeheartedly celebrated the news.
Mr Joseph Inchimootil and the two commemtators above also are biased. Why are they taking various aspects of the case selectively and arguing for the accused? They are as guilty as the media is. Justice Hema has not said that the accused are not guilty. The rule in a criminal trial is: "bail is the rule and jail the exception." And, "Everyone is presumed innocent until proved guilty." Hema's judgement is simply following these principles and nothing more. Her judgement is not the final say in the case. So, will the media, Mr Joseph Inchimootil and others keep quiet so that there is a proper investigation and trial in this case?
ReplyDeleteMr Anonymous (of 11:47AM)- I was only trying to represent the factual observations of Justice Hema about the media & how we public are influenced by the media. No where have I vouched for the accused. Having said that, if you read the entire bail judgment, Justice Hema has given ample indications to believe that the accused are not guilty. The other anonymous have rightly commented that we will only go after sensationalsims & who will waste time in reading Hema's 100 page judgment. It is important to remember that this judgment by Hema was given at a time when the media & public opinion against the accused were at its pinacle. The bail judgment cannot be equated to the judgements by X, Y or Z in some newspapers.
